Hace falta destacar dos formas de normativismo: el normativismo ingenuo y
el normativismo crítico. El normativismo ingenuo adopta una teoría semi-cognoscitivista
de la interpretación, que descansa en la tesis de la indeterminación
parcial de las normas jurídicas. Asume además que la teoría del derecho como
sistema normativo pueda ser útilmente desarrollada dejando de lado el fenómeno
interpretación y proporcionando, por lo tanto, conceptos interpretation-opaque.
El normativismo crítico sostiene en cambio una teoría no-cognoscitivista de la
interpretación jurídica. Asume además que la teoría del derecho como sistema
normativo tendría que tener en cuenta el fenómeno interpretación, proporcionando
conceptos interpretation-sensible, aunque al lado de conceptos interpretation-
opaque. Por esta vía, propone complementar la noción interpretation-opaque
de (micro)sistema estático del normativismo ingenuo con las nociones interpretation-
sensible de microsistema in actu y microsistema in potentia.
Abstract: It seems worthwhile distinguishing two varieties of normativism: naïf normativism
and critical normativism. Naïf normativism adopts a quasi-cognitivist
theory of legal interpretation, grounded on the thesis of legal norms’ partial indeterminacy.
Furthermore, it assumes that the theory of law as a normative system
(“legal system”, “legal order”) may usefully overlook the phenomenon of interpretation,
providing interpretation-opaque concepts. Critical normativism, by
contrast, maintains a non-cognitivist theory of legal interpretation. Furthermore,
it assumes that the theory of law as a normative system may profit from taking
into account the phenomenon of legal interpretation in the very working out of
its basic concepts. Accordingly, it proposes to supplement naïf normativism’s interpretation-opaque notion of static (micro)system with the twin, interpretationdependent,
notions of microsystem in actu and microsystem in potentia.
