Este artículo trata de si en el Derecho español la Administración debe responder de la actuación culposa del práctico. El análisis de esta cuestión está en relación con (o depende de) tanto la condición jurídica del práctico como la naturaleza jurídica del servicio de practicaje; pero principalmente depende del modelo de gestión (directo, indirecto o privado) utilizado para prestar el servicio de practicaje. Teniendo en cuenta la evolución del Derecho español desde el siglo pasado hasta hoy, y considerando asimismo los cambios legislativos que probablemente pueden acaecer, este artículo analiza todos estos temas o subcuestiones y pretende resolver la principal cuestión inicialmente planteada, distinguiendo sobre quién recae la responsabilidad por la actuación culposa del práctico, de acuerdo con los modelos de gestión del servicio del practicaje usados en cada periodo legal.

Abstract: This article concerns the question of the State (Administration) liability which can arise from the negligent performance of the pilot according to the Spanish Law. The analysis of the referred question is in relation with (or depends on) both the juridical condition of the pilot and the juridical nature of the pilotage service; but the analysed question mainly depends on the management model (direct, indirect or private) which is used to give the pilotage service. Having into account the evolution of the Spanish Law since the last century until nowadays and considering the legal changes which can probably happen as well, this paper analyses all these issues and pretends to solve the above-mentioned question, distinguishing whose is the liability for the negligent performance of the pilot, in accordance with the models of management of the pilotage service used in each legal period.
