Este artículo pretende contestar a algunas críticas que Diego Papayannis y Lorena Ramírez formularon a mi reconstrucción de los desacuerdos jurídicos. En particular, en la réplica se arguye que: i) las relaciones conceptuales entre desacuerdos interpretativos y desacuerdos teóricos detectadas por Papayannis y Ramírez son meramente aparentes; ii) las tesis de la indeterminación interpretativa y de la inconsistencia de los sistemas jurídicos son, contrariamente a su opinión,metodológicamente fundadas; y iii) la tesis según la cual el acuerdo es necesario para la existencia de los sistemas jurídicos —en tanto negación de mi tesis según la cual resultaría suficiente la mera eficacia— debe su aparente plausibilidad a
algunas oscuridades conceptuales.
Abstract: This paper is a reply to some criticisms which Diego Papayannis and Lorena Ramírez addressed to my own reconstruction of legal disagreements. In particular, in the present rejoinder, I hold that: i) the conceptual relations between
interpretive and theoretical disagreements, detected by Papayannis and Ramírez, are merely illusory; ii) the theses of the interpretive indeterminacy and the inconsistency of legal systems, contrary to their opinion, are methodologically well-founded; and iii) the thesis according to which agreement is a necessary feature for the existence of legal systems —qua negation of my own thesis that mere effectiveness would be sufficient— is predicated on some conceptual obscurities, which renders it not viable.
