El trabajo analiza el impacto que ha tenido la derogación del art. 379 del CCo por la Ley 15/2009, de 11 de noviembre, del contrato de transporte terrestre, estudiando las diversas interpretaciones dadas al mismo y el influjo que sobre ellas ha tenido la legislación sectorial administrativa del transporte, llegando a la conclusión de que pese a su derogación los efectos que el mencionado artículo producía sobre la libertad de contratación en el ámbito del transporte, especialmente el terrestre, siguen estando presentes no obstante su derogación.

Abstract: The paper analyzes the impact caused by the derogation from the contract of terrestrial transport, of article 379 of the Commercial Code, according to Law 15/2009, of November 11, considering the different interpretations given to same and the influence that the administrative legislation in the transport sector has had on these and concluding that, despite the derogation, the effects that the mentioned article were causing on freedom of hiring in the transport field, particularly in terms of terrestrial transport, are still present despite the derogation.
