L’autore analizza e discute le tesi fondamentali della teoria del diritto di Gaetano
Carcaterra: (i) il principio di normatività (non vi sono entità giuridiche in
natura; il carattere giuridico di una entità qualsivoglia dipende da una norma che
ad essa si riferisca); (ii) la forza costitutiva delle norme (ogni norma è costitutiva
di una nuova entità giuridica). Entrambe le tesi sollevano problemi concettuali
ed ontologici.
Abstract: The author analyzes and discusses the main theses of the Italian legal philosopher
Gaetano Carcaterra, viz. (i) the idea according to which the legal status of
any entity whatsoever depends on the existence of a norm which refers to it, in
such a way that no legal entity exists “in the nature”, and (ii) the idea according
to which any legal norm is provided with a “constitutive force”, in such a way
that it gives rise to some legal entity. Both ideas involve a great deal of conceptual
and ontological problems.
