After a brief inventory of the main theses of so-called new-constitutionalism, the author discusses the connection between law and justice and analyzes the jurisprudential uses of constitutional principles. As to the first topic, the author maintains that the pragmatic, the conceptual, or the contingent (soft-positivistic) connection theses are unsound. As to the second, the author states how the application of rules and principles, respectively, are different and nonetheless connected.
