Résumé: Ce travail porte sur le CC (constitutional comparativism): les références faites
par des Cours suprêmes ou constitutionnelles à des décisions constitutionnelles
étrangères. La première section définit le CC comme argument de l’interprétation
constitutionnelle, en le caractérisant par rapport à la diffusion mondiale
du nouveau constitutionnalisme. La seconde distingue les rôles respectivement
théorique, technique et idéologique que le comparatisme peut jouer dans l’interprétation
constitutionnelle. La troisième section, enfin, analyse trois possibles
justifications du comparatisme —universaliste, différentialiste et mixte— qui
permettent d’en saisir mieux le sens.
Abstract: The subject of this work is constitutional comparativism —the references made
by supreme or constitutional courts to foreign constitutional decisions. The first
section defines constitutional comparativism in terms of a constitutional interpretation’s
argument, situating it in the context of new contitutionalism’s worldwide
diffusion. The second one investigates three roles —theoretical, technical
and ideological— comparativism could play in constitutional interpretation. The
third section, finally, analyzes three justifications of comparativism —universalist,
differentialist, and mixed— which allow a better understanding of its meaning.
