The aim of this article is to analyse the shaping of the intellectual property rights as human or fundamental rights. For this, a review for the main international instruments related to human
rights where intellectual property rights can be identified is carried out. Likewise, there is an assessment on the main conflicts arising when intellectual property rights collide with other fundamental rights, namely the right to health.
