Il saggio ricostruisce criticamente l’analisi della struttura logica degli asserti
distaccati offerta in varie opere da Joseph Raz alla luce della sua concezione
esternalista delle ragioni per agire (§§ 1-2). Vengono esaminate le obiezioni
principali —formulate da Eugenio Bulygin, Kevin Toh e Luís Duarte d’Almeida—
alla tesi di Raz dell’irriducibilità degli asserti distaccati ad asserti interni
ed esterni, cercando di chiarirne la portata, l’efficacia e la dipendenza da una
concezione internalista (§ 3). Nell’ultima parte (§§ 4-5) si cerca di mostrare, sulla
base di considerazioni logico-linguistiche compatibili con il quadro concettuale
proposto dallo stesso Raz, come l’esistenza del tertium genus di asserti da questi
ipotizzato risulti insostenibile per il prodursi di aporie non eliminabili nella sua
teoria del linguaggio giuridico.
Abstract: The paper critically reconstructs the analysis of the logical structure of detached
statements, developed by Joseph Raz in several works, in the light of
his externalist conception of reasons for action (§§ 1-2). The main objections
—formulated by Eugenio Bulygin, Kevin Toh and Luís Duarte d’Almeida— to
Raz’s anti-reductionist approach will be presented, trying to clarify their scope,
efficacy and dependency from an internalist conception (§ 3). In the last part
(§§ 4-5), I will try to show, on the basis of logical-linguistic considerations compatible
with Razian conceptual frame, how the existence of the third genus of
statements he hypothesizes results in some unavoidable contradictions affecting
his theory of legal language.
