L’articolo esamina, seguendo e sviluppando alcune proposte teoriche di Ricardo Caracciolo, i concetti di “regola di riconoscimento” e “defettibilità delle norme giuridiche”. Combinando poi i risultati delle analisi di tali concetti, l’articolo affronta altresì la questione della defettibilità della regola di riconoscimento e dei suoi possibili effetti sulle norme individuate mediante i criteri forniti da tale regola.


Abstract:This paper, which is elaborated along the lines of some of Ricardo Caracciolo’s theoretical proposals, is devoted to the analysis of the concepts “rule of recognition” and “defeasibility of legal norms”. By bringing the outcomes of
such analyses together, the paper also deals with the question of whether the rule of recognition can be regarded as defeasible and whether its possible defeasibility has a bearing on the rules identified on the basis of the criteria it provides.
