El artículo analiza el debate que, en la teoría del derecho anglosajona, se
desarrolla en torno a los desacuerdos jurídicos. En este contexto, se procede a
explorar el marco conceptual dentro del cual se articula el debate y se propone
un refinamiento de la noción central de “desacuerdo teórico”. Dicho refinamiento
conceptual es luego aplicado a los principales casos judiciales discutidos por
quienes participan en el debate. A continuación, se ofrecen dos maneras alternativas
de reconstruir estos casos. Finalmente, el artículo examina y rechaza la tesis
de que el acuerdo sea un rasgo central o incluso necesario del derecho y sostiene
que el rechazo de dicha tesis no supone ninguna amenaza para el positivismo
jurídico, entendido como una empresa científica avalorativa.
Abstract: The paper is devoted to the analysis of the debate, which is going on in
Anglo-American jurisprudence, about legal disagreements. In this context, the
conceptual framework within which the debate is developed is explored and a
refinement of the notion of “theoretical disagreement”, which is central to such
a debate, is put forward. This conceptual refinement is then applied to the main
judicial cases discussed by the participants in the debate and two alternatives ways of reading such cases are propounded. Finally, the paper examines and
rejects the view that agreement is a central or necessary feature of law and argues
that the rejection of such a view is no threat for legal positivism, understood as a
wertfrei scientific enterprise.
