Atendiendo al pensamiento de Ferrajoli, un tema de gran interés es el referente a la jurisdicción, en cuanto a sus funciones para tutelar derechos. Partiendo de este punto se debe estudiar la función jurisdiccional desde varias perspectivas, a saber: como instrumento para el cumplimiento de derechos, aplicación de normas sustantivas a casos concretos, verificación de los hechos sobre la base de las pruebas, la atribución de los órganos jurisdiccionales de interpretar y aplicar la ley existente. Todos estos aspectos se refieren a que la justicia está relacionada con la búsqueda de la verdad de los hechos y que, en
consecuencia, es justo un proceso que está orientado estructuralmente a la investigación y conocimiento de esa verdad.


Abstract:According to Ferrajoli’s thought, there is a subject witch is of great interest, referring to the jurisdiction, as far as its functions go to tutor rights. Starting from this point, the jurisdictional function has to be studied from different perspectives, as an instrument to fulfill rights, to aplicate substantive norms in special
issues, verificating the facts over the base of the evidence, the attribution of the
jurisdictional institutions as they interpret and apply the existing law. All these aspects are referred to the justice related to the seeking of the truth in the facts and consequently, it is a process which is structively orientated to the research and knowledge of that truth.
