El presente artículo analiza las principales obligaciones del cargador conforme a la LCTTM. En primer lugar, el cargador está obligado a entregar las mercancías al porteador en el lugar y en el momento acordados. En segundo lugar, el cargador debe, en principio, entregar las mercancías acondicionadas para su transporte. Además, si se trata de mercancías peligrosas, el cargador debe informar al cargador de su carácter y de las precauciones que deben adoptarse. En tercer lugar, el cargador también tiene que facilitar al porteador la información y la documentación necesaria para realizar el transporte de las mercancías. Finalmente, si el medio de transporte permanece inmovilizado sin que la causa sea imputable al porteador, el cargador deberá responder por los perjuicios ocasionados por dicha inmovilización.

Abstract: The present article analyses the essential duties of the sender according to LCTTM. Firstly, the law requires the sender to delivery goods to the carrier in the agreed time and place. Secondly, the sender must, in principle, delivery goods to the carrier packing and marking. In the event of dangerous goods, the sender also have to inform the carrier of the nature of the danger and if necessary, of the precautions. Thirdly, the sender must provide documents or information necessary to perform the transport of the goods. Finally, if the vehicle stays immobilised without being the cause attributable to the carrier, the sender is responsible for all damage sustained by reason of this immobilised.
