El transporte de mercancías es un contrato cuyos efectos pueden no limitarse a quienes lo concluyen (cargador y porteador). Después de la llegada de las mercancías al lugar de destino, el tercero destinatario también puede reclamar la entrega, la indemnización derivada del incumplimiento y otros derechos que derivan del contrato. Pero la adhesión del destinatario al contrato le hace asumir no sólo esos derechos, sino también las obligaciones que de él derivan y, entre ellas, la de pagar el precio del transporte y los demás gastos generados por el contrato desde su conclusión. Hasta ese momento el porteador sólo podía condicionar la entrega al pago o a la presentación de una garantía por el destinatario. Pero no podía reclamar el pago más que de quien era contraparte: el cargador. Desde que el destinatario reclama la entrega o hace valer otros derechos, pasa a integrarse en el contrato con todas sus consecuencias.
Abstract:Carriage of goods is a contract whose effects can spread beyond the parties who concluded it (carrier and sender). After the arrival of goods at the place of destination, the consignee is entitled to require the carrier to deliver the goods, as well as to claim damages resulting from a breach of the contract and to enforce against him any other rights arising from the contract of carriage. Since the consignee adheres to the contract, he assumes not only those rights, but also duties: to pay the carriage price and other charges resulting from the contract upon its conclusion and thereafter. Until that moment the carrier could not be requested to deliver the goods unless security had been furnished by the consignee. But he could not claim the payment from nobody but the opposing contractual party (sender). Since the consignee claims delivery or enforce any other right arising from the contract of carriage, he enters into the contract with all the consequences.
