La idea del Estado Constitucional de Derecho no es algo nuevo en sí, se trata de una convergencia de ideas y principios, alrededor de la democracia, el derecho, la Constitución, la justicia y la filosofía del derecho, que han dado lugar a una nueva forma de comprender al Estado, en el que la Constitución ocupa el lugar más alto. Este ensayo profundiza, con amplio conocimiento de causa, sobre conceptos como los derechos fundamentales, la democracia y las garantías, visualizándolos como los instrumentos que hacen posible la recomposición de los
derechos fundamentales, con el fin de reflexionar acerca del funcionamiento del sistema jurídico de cara hacia un gestión válida y viable de éste, de manera que se asegure la continuidad del Estado.


Abstract:The concept of Constitutional State of Law is not new in itself; it is a convergence of ideas and principles surrounding democracy, law, the Constitution, justice, and philosophy of law, which has given rise to a new form of understanding the State, in which the Constitution occupies the highest position. This essay analyzes, in great depth and with comprehensive knowledge of cause, concepts such as fundamental rights, democracy, and guarantees, visualizing them as the instruments that make the restoration of fundamental rights possible, in order to reflect upon the functioning of the legal system so as to achieve its valid and viable administration, in such a way that the continuity of the State is guaranteed.
