La concepción jerárquica del derecho pretendía evitar que las normas jurídicas inferiores fueran contrarias a otras superiores a ellas o, dicho en términos más amplios, pretendía evitar la existencia de normas jurídicas irregulares o incorrectas. En mi trabajo reformulo este desideratum y observo que, aunque en la actualidad dicho desideratum no sea realizable, es posible que las tecnologías de la información permitan realizarlo algún día. Describo cómo habría que diseñar un archivo jurídico informático para conseguir dicho objetivo. Sería posible
entonces formular definiciones rigurosas y materialmente correctas de muchas nociones, procedentes de la concepción jerárquica del derecho, que son aplicadas usualmente por la doctrina jurídica a las normas jurídicas o a relaciones entre ellas, pero cuyo sentido no ha sido aclarado hasta ahora. La primera y principal de dichas nociones es la de superioridad estricta. A partir únicamente de ella pueden ser definidas otras nociones como cadena jerárquica, rango jerárquico, ser superior a y tener el mismo rango.


Abstract:The hierarchical conception of law seeked to avoid the fact that legal norms are contrary to others superior to them. More broadly, such conception seeked to avoid the existence of irregular or incorrect legal norms. In my present work I reformulate this desideratum and remark upon the fact that, although at present
such desideratum is not feasible, it, nevertheless, may eventually become possible with the aid of Information Technology. I herein describe how to design a computerized legal archive to achieve the above-mentioned goal. In this way, the possibility of formulating rigorous and materially correct definitions of many notions, enshrined in the hierarchical conception of law, would become a reality. Such notions are usually applied by the legal doctrine to legal norms or relationships between them, but their meaning has not been clarified as yet. The first and foremost of these notions is that of strict superiority. Only starting from this very notion, other notions may be subsequently defined, such as those of hierarchical chain, hierarchical rank, to be superior to, and to have the same rank as.
