El presente documento analiza el tema de la imparcialidad de los jueces e introduce algunos nuevos elementos y planteamientos, como los principios, deberes y diferencias de independencia e imparcialidad de los jueces; el principio de imparcialidad, la abstención y la recusación; y el deber de imparcialidad, decisiones, motivos y críticas. De igual forma, se muestra cómo diferentes concepciones del derecho (por ejemplo, formalista legalista, positivismo normativista, post-positivismo —constitucionalismo— principialista) han
construido de maneras diferentes el ideal del juez imparcial, lo que permitirá mostrar hasta qué punto nuestra cultura jurídica ha confundido neutralidad e imparcialidad.


Abstract:This document analyzes the impartiality of the judges and introduces some new elements and approaches, as the principles, duties and differences on the autonomy and impartiality of the judges; the principle of impartiality, the
abstention and recuse; and the duty of impartiality, decisions, reasons and critics. On the same way, it is shown how different conceptions of law (e.g. legalistic, normative positivism, post-positivism –constitutionalism—principle advocate) have built, on various ways, the ideal of the impartial judge, which will allow to demonstrate how our law culture has mixed neutrality and impartiality.
