El presente trabajo tiene como fin un análisis de la teoría de Jürgen Habermas sobre la reconstrucción interna del derecho, que abarca como punto de partida el discurso en general, que constituye una de las teorías más avanzadas, que además es movida por analistas jurídicos y estudiosos del derecho en vertientes horizontales y verticales en cuanto a partidarios y posiciones, los que están a favor de una u otras teorías, como la teoría de integridad en el derecho de Ronald Dworkin y la teoría de Luis Prieto Sánchiz sobre la ponderación en el derecho, vistas con una visión social, jurídica y democrática.


Abstract:This essay has one objective, to analyze the Jürgen Habermas theory about the reconstruction of internal law, which covers as a start the speech in general, which is one of the most advanced theories, seen by law analysts and who study law, taken into other horizons, as to who favor this kind of theories and those who do not, like the theory of the integrity of law of Ronald Dworkin and Luis Prieto Sanchi’s Theory of the value of law, seen with a social, juridical and democratic point of view.
