Respondiendo a las objeciones y matices de los jóvenes investigadores del Di.Gi.Ta., el autor añade a su (re)construcción del imperio de la ley algunas precisiones, entre otras, las siguientes: i) la autonomía personal (en tanto condición de inteligibilidad de la institución misma) es una presunción normativa que de hecho empleamos gradualmente; ii) lo que transforma nuestros contextos de decisión en contextos paramétricos es el conocimiento genérico (dado por normas) de una actitud estándar del agente respecto a sus preferencias; iii) la naturaleza del ideal de autonomía fuerza un tipo estratificado de argumentación práctica (que permite albergar doctrinas comprehensivas incompatibles); iv) el derecho puede existir
también antes del poder; v) el significado a-contextual no tiene por qué ser irreal o intemporal, y vi) el propósito de la ley no está en la intención del legislador.
Abstract: In response to critical accounts of his (re)construction of the Rule of law, the author here presents some refinements of his view, such as: i) personal autonomy (being a condition of the intelligibility of Rule of Law) is a normative presumption that is actually being applied in a gradual manner; ii) norms provide us
with generic knowledge of a standard agent behavior in front of her preferences (thus turning our decision-making contexts in parametric contexts); iii) the very character of the ideal of autonomy imposes a stratified type of practical reasoning (which allows to embrace even incompatible comprehensive doctrines); iv) the existence of law can well precede the existence of power; v) an a-contextual meaning is not necessarily unreal or atemporal; vi) one needs to distinguish the purpose of a law and the intent of the legislature.
