El constitucionalismo garantista de Ferrajoli representa uno de los últimos baluartes
de la modernidad en la filosofía jurídica contemporánea. Los argumentos que Ferrajoli opone
al constitucionalismo principialista en lo que atañe al objetivismo y cognoscitivismo moral y a la
tesis de la conexión necesaria entre Derecho y moral pueden ser complementados, brindando el
ataque al corazón mismo del enfoque objetivista y conexionista.


Abstract:Ferrajoli’s positivistic constitutionalism (costituzionalismo garantista) represents one of
the last strongholds of modernity in contemporary jurisprudence. The arguments Ferrajoli provides
against so called neo-constitutionalism (costituzionalismo principialista), concerning moral
objectivism and cognitivism and the necessary connection between law and morals, may be complemented
bringing the attack to the very heart of the objectivist and connectionist outlook.
