El trabajo aborda el estudio de las medidas de tolerancia en los textos jurídicos de la
época de la Reforma, como son el Pacto de Confederación de Varsovia (1573), el
Edicto de Nantes (1598) y la Paz de Westfalia (1648), dedicándose especial atención
a los principios procedimentales (itio in partes y amicabilis compositio) a través de
los cuales se adoptaron las medias sobre ejercicio de la religión. Estas normas centroeuropeas
se comparan con la situación en España: en los territorios de ultramar y en
la península ibérica. La razón de Estado justificó en muchos casos estas medidas.
Abstract: The work undertakes the study of the measurements of tolerance in the legal texts
during the Reformation, as the Act of Warsaw Confederation (1573), the Edict of
Nantes (1598) and the Peace of Westfalia (1648), devoting special attention to the
procedural principles (itio in partis and amicabilis compositio) through which were
adopted the measures on exercise of the religion. These Central European norms are
compared with the situation in Spain, both in the overseas territories and the Iberian
Peninsula. The reason of State justified in many cases these measurements.
Zusammenfassung: Die Arbeit umfasst die Untersuchung der Toleranzregelungen in den juristischen
Texten der Reformationszeit. Darunter zählen die Warschauer Konföderationsakte (1573), das Edikt von Nantes (1598) und der Westfälische Frieden (1648). Besonders
berücksichtigt wurden die Verfahrensgrundsätze (itio in partes y amicabilis
compositio), durch welche die Regelungen zur Religionsausübung festgelegt wurden.
Diese zentraleuropäischen Normen werden mit der Situation in Spanien verglichen:
in den Überseegebieten und auf der Iberischen Halbinsel. In vielen Fällen
hat die Staatsräson diese Regelungen gerechtfertigt.
