Seguridad jurídica y previsibilidad

El objetivo de este trabajo es defender una concepción de la seguridad jurídica que resulte
coherente con las exigencias normativas del Estado constitucional de derecho. Como intentaré
mostrar, ello implica «sustantivizar» un tanto las exigencias que se derivan de este valor, que
suele presentarse —de manera un tanto imprecisa— como exclusivamente «formal».
Abstract:The purpose of this paper is to explore a conception of the value of legal certainty that
could be soundly considered coherent with the normative requirements of a Constitutional Ruleof-
Law State. I argue that we need to depart from a somehow —as I will argue— purely formal
understanding of the requirements imposed by such value and to consider that they need to be
provided with a substantive content.
