In questo saggio vengono prese in esame le caratteristiche peculiari dello
scetticismo interpretativo moderato, nella versione proposta da alcuni tra i più
illustri esponenti della c.d. scuola genovese. Ciò al fine di mettere in relazione
gli assunti-cardine di tale teoria meta-interpretativa con la teoria delle lacune
che sembra inevitabilmente scaturirne e che gli scettici à la génoise non sembrano
però tenere in debito conto. In particolare, all’interno del paper vengono
avanzate due tesi contrarie alla ricostruzione delle lacune del diritto proposta da
Riccardo Guastini e da Pierluigi Chiassoni. La prima tesi afferma che —contrariamente
a quanto sostenuto dagli scettici à la génoise— le lacune normative non
sono variabili dipendenti dell’interpretazione decisoria. La seconda tesi avanzata
nel saggio non è altro che la riproposizione della teoria delle lacune assiologiche
formulata da Alchourrón e Bulygin in Normative Sistems.
Abstract: In this essay some of the peculiar features of moderate interpretive scepticism,
in the version suggested by some members of the so-called “Genoese
School”, are discussed. This exam is aimed at connecting the pivot assumptions
of such a meta-interpretive theory to the theory of legal gaps which appears to
be its obvious consequence, although “Genoese Sceptics” do not seem aware of
it. In particular, the reconstruction of legal gaps proposed by R. Guastini and
P. Chiassoni is contested by maintaining two theses. The first one states that
—contrary to what the “Genoese Sceptics” maintain— normative gaps do not
depend on adjudicating interpretation. The second one is but a new formulation
of theory of axiological gaps worked out by Alchourrón and Bulygin in Normative
Systems.
