Sommario: Nel dibattito giusfilosofico italiano, il concetto di regola costitutiva anima una discussione che spesso si polarizza su due opposti “partiti”: da un lato, vi sono coloro che ritengono che le regole costitutive abbiano una effettiva portata
ontologica; dall’altro, vi sono coloro che ritengono, invece, che le regole costitutive
non siano nella sostanza diverse dalle altre regole, e che la loro apparente
peculiarità sia in realtà riconducibile a fenomeni normativi più noti e meno controversi.
La medesima polarizzazione si ripercuote su tutte le questioni riguardanti
le regole costitutive, la loro natura e funzione. In questo lavoro, affronterò
il problema del rapporto tra regole costitutive e regole tecniche e cercherò di
mostrare, con riferimento a questo problema, che il suddetto contrasto di fondo
non ha ragion d’essere.
Abstract: In Italian legal philosophy, the concept of constitutive rule usually gives place
to a discussion that divides scholars into two different groups: on the one hand,
there are those who think that constitutive rules can have an effective ontological
bearing; on the other hand, there are those who instead maintain that constitutive
rules are not substantially different from other rules and that their apparent
peculiarity can in reality be explained by tracing them to better-known and less
controversial normative phenomena. This same distinction has a bearing when
dealing with all the questions related to constitutive rules, their nature, and function.
In this paper, I will address the question of the relation between constitutive
rules and technical norms and will try to show that the above-mentioned distinction
is groundless.
