Mediante el presente artículo, se analizan las principales características y peculiaridades de las distintas clases de cooperativas que operan en el sector del transporte, fundamentalmente en relación con el resto de cooperativas. De este modo, se estudia el régimen jurídico de las cooperativas de transportistas y las cooperativas de transporte de trabajo asociado, con especial mención a la problemática que surge de la confusión de ambos tipos de cooperativas, con gran trascendencia de cara a las autorizaciones de transporte, funcionamiento de la sociedad, etc., problemática que es patente en la práctica empresarial y la jurisprudencia. Asimismo, se hace referencia a las cooperativas de transporte mixtas, en particular si existe o no la posibilidad de constituirlas según la legislación sectorial del transporte.

Abstract:This article analyzes the main features and peculiarities of the different kind of cooperatives which operate in the transport sector, chiefly regarding to the rest of cooperatives. Thus, it studies the legal framework of the cooperatives of carriers and the transport cooperatives of associated work, making special mention of the problems caused by the confusion between these two kinds of cooperatives, which have a great significance with regard to transport licences, operations of the enterprise, etc., problems which are obvious in the practice of these cooperatives and case law. Likewise, it refers to mixed transport cooperatives, particularly the possibility (or not) of constituting them pursuant to transport legislation.
