La celebración de un contrato de transporte terrestre de mercancías genera ciertas obligaciones que deben cumplirse antes incluso de producirse la recepción de las mercancías por parte del porteador. De entre ellas destaca por su importancia para un correcto desenvolvimiento del transporte la obligación del porteador de proveer, en el lugar y plazo pactados, un vehículo que sea idóneo para el transporte de las mercancías objeto del contrato. El presente estudio analiza las cuestiones más relevantes en torno a la elección del vehículo por parte del transportista, así como las consecuencias jurídicas derivadas, tanto de la puesta a disposición de un vehículo no apto para el transporte, como del incumplimiento o cumplimiento defectuoso de la obligación de suministrar el vehículo en el lugar y tiempo convenidos.

Abstract: The conclusion of a contract of carriage by land creates certain obligations to be performed even before the goods are taken over by the carrier. Among them, the obligation of the latter to provide a vehicle suitable for the carriage of the goods that represent the subject-matter of the contract at the place and within the time agreed upon by the parties stands out due to its importance for the correct development of the carriage. The present study analyzes the most important issues as regards the choice of a vehicle by the carrier, as well as the legal consequences derived from either the provision of a vehicle that does not suit the goods or the failure to supply the vehicle at the place and within the time limit established by the contract.
