Resumen

Does the subversive populism that Donald Trump promoted during his presidency find fertile ground in the loopholes and fragilities hidden in the wrinkles of the normative tissue of the US Constitution? In the attempt to answer this question, the article explores the many ways through which the former President of the United States stressed the contradictions of the American constitutional system to
the point of almost subverting it. From the Electoral College mechanism to the «counter majoritarian problem», from the peculiarity of conceding defeat to the checks and balances equilibrium and its feebleness, the article analyses how Donald Trump took advantage of the flaws and weaknesses of the legal structure. Good laws are better than good governors are. This is why it is important in the Author’s perspective to address the dark sides of the United States legal system in view of a necessary reform.
