Resumen

(Notas): Trabajo de Iniciación a la Investigación en el Área de Derecho Procesal, dentro del Programa de Doctorado coordinado por Don Jaime Vegas Torres “Estudios de Derecho e Investigación Jurídica”, de la Facultad de Ciencias Jurídicas y Sociales de la Universidad Rey Juan Carlos; bajo la dirección de la Profesora Doña María Lidón Montón García.
A punto de cumplirse seis años de vigencia de la Ley de Enjuiciamiento Civil 1/2000, de 7 de Enero, nos disponemos a estudiar en el presente trabajo, una de las grandes novedades que se nos presentaban en el citado texto legal y a su vez uno de los motivos por los cuales no resultó aprobado en su totalidad, a saber, “el recurso extraordinario por infracción procesal”. Mediante dicho instrumento se pretendía dejar fuera del tradicional instituto de la Casación la infracción de normas procesales, atribuyendo competencias exclusivas a los Tribunales Superiores de Justicia para su conocimiento; justificándose por el legislador por la existencia de una interpretación consolidada por parte del Tribunal Constitucional en muchas materias procesales. La regulación que la LEC hace, conviviendo con el tradicional recurso de casación, además de la existencia de un régimen transitorio aplicable a los recursos extraordinarios-ex. D.F. 16º LEC-, y con un futuro proyecto de ley de reforma del recurso de casación en ciernes; hacen que la regulación se torne compleja, pero a la vez digna de estudio, sobre todo cuando dicha regulación constituye, como veremos, un auténtico “óbice a los fines casacionales en el ordenamiento jurídico español”. Finalmente, analizaremos la futura reforma de la casación, desde la óptica del Análisis Económico del derecho.

Abstract: Work of Initiation to the Investigation in the Area of Procedural Right, within the Program of Doctorate coordinated by Don Jaime Vegas Torres “Studies of Right and Legal Investigation”, of the Faculty of Legal and Social Science of the University Rey Juan Carlos; under the direction of Professor Doña María Lidón Montón García.
On the verge of turning six years of use of the Law the Civil Judgment 1/2000, 7 of January, we have ourselves to study in the present work, one of the great new features that appeared to us as well in mentioned legal text and one of the reasons by which it was not approved in his totality, that is to say, “the extraordinary resource by procedural infraction”. By means of this instrument it was tried to leave outside the traditional institute of the Abrogation the infraction of procedural norms, attributing exclusive competitions to the Superior Courts of Justice for his knowledge; justifying itself by the legislator by existence of an interpretation consolidated on the part of the Constitutional Court in many procedural matters. The regulation that the LEC does, coexisting with the traditional resource of abrogation, in addition to the existence of a transient state applicable to the extraordinary resources – final disposition 16º LEC -, and with a future project of Law of reform of the resource of abrogation in blossoming; they cause that the regulation becomes complex, but simultaneously worthy of study, mainly when this regulation constitutes, as we see, authentic impediment to the casacionales aims. Finally, we will analyze the future reform of the abrogation, from the optics of “Law and Economics”.
