L’oggetto di questo lavoro è una analisi di alcuni possibili significati a) del
concetto di “esistenza” riferito ad entità giuridiche, e b) del concetto di gerarchia
normativa. In particolare, dopo aver distinto disposizioni e norme, vengono
individuate tre differenti dimensioni dell’esistenza sia di disposizioni che di
norme: l’efficacia, la validità, e l’applicabilità. Sono inoltre individuati tre distinti
significati di “gerarchia normativa”, e ciascuno di essi viene messo in relazione ad
alcune delle dimensioni di esistenza (di disposizioni o di norme) viste sopra.

Abstract: The article proposes an analysis of a) the concept of “existence” of laws, and
b) the concept of hierarchy of legal norms. The analysis of the existence of laws
requires as a first step a distinction between enacted legal texts on the one hand,
and legal norms on the other. With this distinction in mind, it will be possible to
fully articulate the concept of existence of laws in three more precise concepts:
effectiveness, validity, and applicability, either of texts or of norms respectively.
Also the concept of hierarchy of norms deserves close theoretical scrutiny, leading
to a distinction between three different kinds of hierarchy, each of which is
related to a specific dimension of the existence of laws.
