El objeto de este trabajo consiste en criticar la compatibilidad asumida como posible por
Luigi Ferrajoli entre el positivismo jurídico y el llamado «neoconstitucionalismo», lo cual vale
para cualquier significado coherente posible de esta ambigua corriente jurídica. Los argumentos
principales son los siguientes: 1) El neoconstitucionalismo no es compatible con el esencialismo
que no sólo positivistas, sino también jusnaturalistas asumen implícitamente al definir Derecho.
2) El neoconstitucionalismo tampoco es compatible con el formalismo de Ferrajoli. 3) El
neoconstitucionalismo no es compatible con la tesis de la separación. 4) El neoconstitucionalismo
no es compatible con la metaética que subyace a la filosofía jurídica de Ferrajoli.
Abstract:The aim of this essay is to critize the compatibility assumed as possible by Luigi Ferrajoli
between legal positivism and the so-called «neoconstitutionalism»; this applies to every possible
coherent meaning of this ambiguous legal trend. The main arguments are the following: 1) Neoconstitutionalism
is not compatible with the essentialism that not only positivistic but also natural
law authors implicitly assume when defining Law. 2) Neoconstitutionalism is not compatible with
Ferrajoli’s legal formalism either. 3) Neoconstitutionalism is not compatible with the separation
thesis. 4) Neoconstitutionalism is not compatible with the metaethics that underlies Ferrajoli’s
legal philosophy.
