La ilegalización de Herri Batasuna, Euskal Herritarrok y Batasuna (Sentencia del
Tribunal Supremo de 27 de marzo de 2003) comportó una serie de consecuencias
que son analizadas en el presente trabajo. En primer lugar, la estrategia de presentar
en sucesivos comicios (elecciones municipales y autonómicas de 2003, elecciones
al Parlamento Europeo de 2004 y elecciones al Parlamento vasco de 2005) agrupaciones
electorales que no eran más que continuación de aquéllos con la clara intención
de burlar la aplicación de la Ley Orgánica de Partidos Políticos y perpetuar así
su actividad. En segundo lugar, la polémica sobre la disolución del grupo parlamentario
correspondiente en el Parlamento vasco ordenada por el Tribunal Supremo en
su Auto de 24 de abril de 2003. Y, en tercer lugar, el procesamiento de varios componentes
de la Mesa de dicho Parlamento por no proceder a la disolución.
Abstract: The banning of Herri Batasuna, Euskal Herritarrok and Batasuna (following the
decision of the Spanish Supreme Court adopted the 27th March, 2003) entailed
important consequences in the political realm. Firstly, the appearance of several political
forces (composed, in fact, by the same agents) which tried to dodge the Organic
Law of Political Parties (Ley Orgánica de Partidos Políticos) in the municipal and regional elections of 2003, the elections to the European Parliament in 2004, and the
elections to the Basque Parliament of 2005. Secondly, the fierce debate on the dissolution
of the political group in the Basque parliament ordered by the Supreme Court
on April, 24th 2003. Thirdly, the trial of several members of the Basque parliamentary
committee, due to their refusal to comply with the decision of the Supreme Court.
Zusammenfassung: Die Illegalisierung von Herri Batasuna, Euskal Herritarrok und Batasuna (Urteil
vom Obersten Gerichtshof vom 27. März 2003) brachte mit sich eine Reihe von
Konsequenzen, die in dieser Arbeit analysiert werden. Erstens, die Strategie, um in
den folgenden Wahlen (Kommunalwahl und Regionswahl aus 2003, europäische
Parlamentswahl aus 2004, baskische Parlamentswahl aus 2005) diejenige Wahlgruppe
vorzuschlagen, die nichts mehr als Fortsetzung diejenigen Gruppen mit der
klaren Absicht, die Anwendung des Organischen Gesetzes von Politische Parteien
(Ley Orgánica de Partidos Políticos) umzugehen und auf diese Weise ihre Aktivitäten
zu verewigen. Zweitens, die Polemik über die Auflösung der entsprechenden
parlamentarischen Gruppe, die von dem Obersten Gerichtshof in seinem Gerichtsbeschluss
vom 24. April 2003 angeordnet wurde.
