Notre propos se donne pour objectif de rendre compte d’une difficulté de la théorie constitutionnelle face aux effets controversés de l’interprétation. Dans les systèmes de constitution rigide, la procédure de révision constitutionnelle est réputée fonder la validité d’un changement de signification. Aussi les défauts supposés de l’interprétation constitutionnelle signalent-ils un potentiel déraillement de cette autorégulation dynamique et conduisent à reconsidérer le concept
de validité. Ces phénomènes d’interprétations imparfaites ne sont donc pas seulement un problème au regard de la possibilité d’une connaissance des significations —problème qui ne sera pas abordé ici— mais également dans le positionnement qu’entretient le juriste face à son objet, entre stabilité et reconstruction.


Abstract: The main purpose of this paper is to explain the difficulties that constitutional theory faces with regard to the disputed effects of interpretation. In rigid constitutional systems, it is said that the rule of constitutional revision founds the validity of every constitutional change of meaning. Possible defects of interpretation thus point to a failure in the system of dynamic autoregulation and force us
to reconsider the concept of validity. Indeed these phenomena of imperfections in the process of interpretation are not only problematic in terms of knowledge of meanings —this topic falling beyond the scope of this paper— but also in terms of the position that we jurists have toward our object, between stability and reconstruction
