El presente trabajo tiene por objeto la reconstrucción sintetizada del itinerario seguido por la indicada Ley desde la elaboración del Anteproyecto que le sirvió de base hasta la aprobación y publicación del texto final vigente. A tal fin se distinguen las tres fases por las que transcurre tal itinerario: la prelegislativa o preparatoria, en la que se configura la propuesta inicial por un grupo de expertos; la gubernamental, en la que el Anteproyecto se convierte en Proyecto de Ley, tras perfilarse como ámbito normativo el transporte terrestre de mercancías y desecharse por variadas razones el transporte de viajeros; la propiamente legislativa, en la que el Proyecto presentado al Parlamento resulta sucesivamente tramitado en el Congreso de los Diputados y en el Senado, siendo objeto de debate, enmienda y aprobación hasta convertirse en Ley publicada y vigente. A lo largo del proceso se ponen de manifiesto las cuestiones que fueron objeto de discusión y los cambios experimentados en el texto tramitado, lo que tiene especialidad utilidad para un mejor conocimiento e interpretación de la norma.

Abstract:This paper seeks to reconstruct in a succinct manner the route followed by the legislation in question from preparing the preliminary draft used as the basis for the legislation to the approval and publication of the final Act that is in force. The route is therefore broken down into three phases: the pre-legislative or preparatory stage, where the initial proposal was prepared by a group of experts. This is followed by the governmental stage, when the preliminary draft became a Bill, after freight transport by land had been established as the legislative sphere and passenger transport had been rejected for a variety of reasons. The route ended with the legislative stage, when the bill submitted to Parliament was passed through the lower and upper houses of the Spanish parliament, where it was debated, amended and approved until it became a published Act in force. The questions discussed and the changes to the legislation are considered throughout the process, which make it particularly useful for better knowledge and interpretation of the legislation.
