(Notas): El presente trabajo versa sobre la sucesión de las partes en el proceso por muerte de los litigantes iniciales, regulada con carácter general en el artículo 16 de la Ley de Enjuiciamiento Civil y en el 540 del mismo Texto Legal en el ámbito de la ejecución, desde una visión procesal, incluyendo los ámbitos subjetivo y objetivo, así como los requisitos formales y sustantivos.
Todo ello a través de un análisis del procedimiento en los supuestos recogidos en la norma, especialmente cuando la defunción se comunica al Juzgado a través del sucesor del litigante fallecido o por persona distinta del sucesor.

Abstract: This piece of work addresses the sucession of the parties to a legal proceedings upon the dicease of the initial litigants, wich is contemplated, on a general basis, in section 16 of the Law of Civil Procedure, and also in section 540 of said Law, in the framework of the execution of judgements. The subject matter has been dealt with from a procedural standpoint, including an analysis of the objective and subjective elements, as well as of the formal and substantive requirements. All of it has been done through an analysis of the legal procedure in all the events that have been set forth in the rule, and specially when the decease is communicated to the Court through the sucessor of the deceased litigant or by a other person than the sucessor.
