La responsabilidad judicial ha sido un elemento importante en la consolidación del
Estado contemporáneo en cuanto ha servido para reforzar aspectos esenciales de la
división de poderes. En España desde la Constitución de Cádiz se trabajó para dar
forma y contenido a este instrumento desde bases y argumentos jurídicos. Junto con
la inamovilidad judicial, la independencia de los jueces se completó en su estructura
interna con la responsabilidad y la motivación. Se consiguió hacerla realidad no sólo
teórica, sino práctica, a partir de la LOPJ de 1870.
Abstract: Judiciary responsibility has been an important element in the consolidation of the
modern nation as far as it has helped to reinforce essential aspects of the division
of powers. In Spain the Constitution of Cádiz of 1812 contributed to the formation
and development of this instrument from juridical bases and arguments. Beside judiciary
immobility, judge’s independence was completed in its internal structure with
responsibility and motivation. It all finally worked out not only theoretically but
also practically since the Organic Law of the Judicial Power (Ley Orgánica del Poder
Judicial, LOPJ) of 1870.
Zusammenfassung: Die juridische Verantwortung ist ein wichtiges Element für die Festigung des gegenwärtigen
Staates gewesen, indem sie dazu diente, die wesentlichen Aspekte der Machtaufteilung
zu verstärken. In Spanien hat sich seit der Verfassung von Cádiz von 1812
daran gearbeitet, diesem Instrument, von juridischen Grundlagen und Argumenten
her, Form und Inhalt zu geben. Zusammen mit der juridischen Unabsetzbarkeit hat
sich die Unabhängigkeit der Richter in ihrer inneren Struktur mit der Verantwortung und mit der Motivation ergänzt. Seit dem Organgesetz über die rechtsprechende
Gewalt (Ley Orgánica del Poder Judicial, LOPJ) aus dem Jahr 1870 hat man erreicht,
sie sowohl theoretisch als auch praktisch durchzuführen.
