POR ELLO, EL AUTOR REFLEXIONA Y ARROJA CONCLUSIONES ACERCA DE CUESTIONAMIENTOS ESPECÍFICOS EN TORNO A ESTE DEBATE, COMO LA SIGUIENTE: ¿HASTA DÓNDE RESULTA POSIBLE PONDERAR DERECHOS O GARANTÍAS INDIVIDUALES DE LOS CIUDADANOS EN LA TOMA DE DECISIONES JURISDICCIONALES, CUANDO NO HAY PARÁMETROS PARA MEDIR DE MANERA CUALITATIVA LA EFECTIVIDAD Y CALIDAD DE UNA RESOLUCIÓN JURISDICCIONAL?; DEBIDO A QUE PERSISTE LA PRÁCTICA DE UNA PERSPECTIVA EQUIVOCADA DEL SIGNIFICADO Y NATURALEZA DE LA FUNCIÓN JURISDICCIONAL, AL CONTEMPLARLA COMO UNA ENTIDAD INTOCABLE, PESE A QUE ES EL MISMO PODER DEL ESTADO EL QUE LLEGA A VULNERAR LOS DERECHOS SUSTANCIALES
Y PROCESALES DE LOS JUSTICIABLES, ASÍ COMO SUS GARANTÍAS INDIVIDUALES.


Abstract:This article goes deeper into the convenience of the delegation for jurisdictional functions over the constitutional and ordinary laws, from different degrees and competence levels that may grant validity and efficacy to the normative precepts and therefore generate a better society. Therefore, the author reflects and makes conclusions regarding the specific issues around this debate, such as the following: How far is it still possible to think about rights or individual rights of the citizens in jurisdictional decision making, when there are no parameters for measuring qualitatively the efficacy and quality of the jurisdictional resolution since the practice of an erroneous perspective of the meaning and nature of the jurisdictional function is persistent, when seen as an untouchable entity, despite of being the State itself the one that hinders the substantial and procedural rights of those subject to such jurisdiction, as well as their individual rights.
