El presente ensayo proporcionará una serie de argumentos, utilizando el método
deductivo, a fin de sustentar la necesidad de implementar en nuestro
sistema jurídico la figura de la cuestión prejudicial, en específico a la materia
electoral, dadas las facultades concurrentes de los órganos que conforman el
Poder Judicial de la Federación, ya que, el Tribunal Electoral no sólo tiene la
encomienda legal de substanciar y resolver los medios de defensa en materia
electoral, sino también de pronunciarse respecto de la inconstitucionalidad
de preceptos legales, atribución originaria de la Suprema Corte de Justicia de
la Nación; de ahí la necesidad que previo al proceso judicial, se requiera un
procedimiento ad hoc para el esclarecimiento de cualquier duda o trámite.


Abstract:The present essay will provide a series of arguments, using the deductive method,
to support the need to implement in our legal system the prejudicial matter figure,
in specific, in the electoral branch, given the concurrent faculties which have
the organs of the Federal Judiciary, because the Electoral Court has not only the
legal mission to process and resolve the defense mechanisms for electoral matters,
but also the duty to pronounce itself about the unconstitutionality of legal
precepts, originally a competence of the Supreme Court of Justice of the Nation;
there comes the need that before the judicial process we require an ad hoc procedure
for the clearing up of any doubt or process.
