El presente artículo tiene por objeto analizar las principales modificaciones introducidas por la Ley 15/2009 del Contrato de Transporte de Mercancías en el proceso de cuantificación y limitación de la deuda indemnizatoria del porteador. Aunque en este ámbito la norma se ha mostrado conservadora respecto de la regulación anterior, es posible destacar aspectos novedosos que vienen a cubrir lagunas y solventar problemas interpretativos planteados por los preceptos que tanto el CCo, como la LOTT y su Reglamento dedicaron a la materia. En este sentido, conviene destacar la introducción de pautas concretas de valoración del daño ocasionado por la pérdida, avería o retraso de la mercancía, las modificaciones en la fórmula de cálculo de la suma indemnizatoria máxima, o la posibilidad de introducir en el contrato la cláusula de declaración de interés en la entrega a ejemplo de lo previsto en el CMR o en el COTIF-CIM.

Abstract:This article is devoted to analyze the main changes operated by Law 15/2009 on the Carriage of Goods by Land in the process of quantification and limitation of carrier’s indemnity debt. Although the Law has been very conservative in this field regarding the previous regulation, it is possible to distinguish certain issues which have filled gaps or solved interpretation problems caused by the different articles which both, the Commercial Code as the LOTT dedicated to this question. In this sense, it should be noted the introduction of guidelines in order to value the damages caused by the carrier, the changes made in the formula to calculate the maximum amount of liability or the possibility of using the declaration of interest in delivery following the example of the provisions of the CMR of the COTIF-CIM.
