Los Convenios internacionales sobre transporte de mercancías por mar tienen como objetivo establecer un régimen uniforme imperativo que impida al porteador abusar de su posición de superioridad en la celebración del contrato. Por eso uno de los aspectos más importantes en estos Convenios es la delimitación del alcance de la autonomía de la voluntad. El nuevo Convenio de UNCITRAL regula con detalle esta cuestión, tratando de tener en cuenta todos los intereses en juego. Este artículo analiza el juego de la autonomía de la voluntad en los distintos Convenios sobre transporte marítimo, tanto en su vertiente contractual como en la conflictual y la jurisdiccional.
Abstract: The international Conventions on carriage of goods by sea aim to establish a uniform imperative regime to avoid the carrier to take advantage of his position in a contract. That is the reason why the extent of party autonomy is one of the main aspects in the Conventions. The new UNCITRAL Convention has a detailed regime on this issue taking into account all the interests at stake. This paper analyzes the role of party autonomy in the Conventions on carriage of goods by sea in three areas: the drafting of the contract, the choice of court and the choice of law.
