En el presente estudio se aborda un estudio comparativo de las STC 75/1984,
53/1985 y 70/1985 y de la visión de las mismas en relación a la espinosa cuestión
del aborto. En el momento de su emisión (a mediados de la década de los ochenta),
la reforma de la legislación sobre la interrupción del embarazo era objeto de debate
público en la vida española, tanto a iniciativa del Gobierno como de algunas
organizaciones sociales, las cuales pretendían una ampliación de los supuestos en los
que este delicado asunto no pudiera ser punible en nuestro país. En este sentido,
uno de los principales defensores de la despenalización del aborto en España fue
don Francisco Tomás y Valiente (1932-1996).

Abstract: In this work is approached a comparative study of the STC 75/1984, 53/1985 and
70/1985 and of the perspective of the same ones in relation to the thorny question
of abortion. At that moment (around the middle of the Eighty), the reformation of
the legislation on the interruption of the pregnancy was object of public debate in
the Spanish life, not only as an initiative of the Government, but also of some social
organizations which aimed to increase the suppositions in those this delicate matter
could not be punishable in Spain. In this sense, one of the main defenders of the
decriminalization of abortion in Spain was Francisco Tomás y Valiente (1932-
1996).

Zusammenfassung: In anwesender Arbeit wird eine komparative Studie über STC 75/1984, 53/1985
Y 70/1985 und über das Sehvermögen dieser mit Bezug auf die heikele Abtreibungsfrage
angeschnitten. In dem Moment ihrer Bekanntmachung war (im Hälfte
80er Jahre) die Reform der Gesetzgebung über Schwangerschaftunterbrechung eine
offene Debattengrund im spanischen Leben, unterstützt sowie von der Regierung
als auch von den sozialen Organisationen, die ihrerseits eine Annahmenerweiterung,
wegen deren diese heikele Angelegenheiten nicht bestrafbar in unserem Land
waren, verlangt haben. In diesem Sinn war Professor Tomás y Valiente einer der
wichtigsten Beschützer der Straffbefreiung der Abtreibung in Spanien (1932-1996).
