El Anteproyecto de Ley de Código Mercantil, recientemente publicado, incorpora el régimen del contrato de seguros. El nuevo texto, integrado en el Libro Quinto, Título VIII, supone un cambio de planteamiento respecto del modelo anterior recogido en el último Anteproyecto de Ley de Contrato de Seguro (versión junio, 2011). A diferencia de la última previsión normativa, no se traslada su sede a la Ley del contrato de transporte terrestre de mercancías por carretera, sino que lo mantiene dentro de su sede natural —seguro de daños—. No obstante, el contenido de la redacción en materia de seguros de transporte mantiene, en líneas generales, la misma redacción. El presente trabajo analiza el nuevo Anteproyecto desde la perspectiva de los seguros de transporte y sus diferencias con el régimen vigente —también con la propuesta anterior de reforma—, y, al mismo tiempo, sugiere mejoras en su redacción, a fin de que puedan ser atendidas en el proceso legislativo.

Abstract: The Draft Act on Commercial Code, recently published, incorporates the insurance contract. The new text —integrated into the 5th Book, Title VIII— represents a change compared with the previous model gathered in the last Draft of Insurance Contract Act (version June, 2011). Unlike this one, its location does not move to the legal status of the contract of carriage of goods by road, but it is maintained within the insurance of damages —natural location—. Nevertheless, the content of the Draft on the subject of transport insurances maintains, generally, the same writing. This article analyzes the new Draft from the perspective of the transport insurance and their differences with the current legislation —also with the previous model—, and, at the same time, it suggests improvements to the text, in order to be useful in the legislative process.
