prefiere denominar «postpositivismo») realmente sostiene.
Abstract:This work is divided in three parts. In the first, the author shows why the characterization
that Ferrajoli presents of the kind of constitutionalism that he calls «principialist» or «argumentative
» is wrong. In the second, the nature of this last conception (that the author prefers to
denominate as «postpositivist») is clarified. Lastly, the author identifies the thesis that Ferrajoli’s
«normativist» constitutionalism should abandon in order to achieve the aims that Ferrajoli himself
attributes to a theory of law.
