Resumen

El transportista debe realizar el viaje con la diligencia necesaria para transportar al pasajero incólume, por lo que asume una obligación de seguridad que puede calificarse como de resultado, inherente al transporte y de cuyo incumplimiento responde. El Reglamento (CE) núm. 392/2009, de 23 de abril, supone un avance significativo hacia la uniformidad del régimen de responsabilidad del transportista por daños a los pasajeros, pues conlleva como novedad en un futuro próximo la aplicación a todos los Estados miembros del Convenio de Atenas reformado conforme al Protocolo de Londres 2002 y cuya disciplina resultará de aplicación no sólo a los transportes internacionales sino también a los que se realicen dentro de un Estado miembro. En el presente trabajo se analiza la obligación de seguridad del transportista marítimo y el régimen vigente de la responsabilidad del transportista marítimo de pasajeros que deriva de su incumplimiento, en el ámbito nacional e internacional, y la objetivización progresiva que está sufriendo, pues el Reglamento (CE) núm. 392/2009 supone un cambio significativo al establecer un régimen híbrido entre la responsabilidad basada en la culpa y responsabilidad basada en el riesgo que pone de manifiesto la necesidad reequilibrar los distintos intereses en presencia, el de los transportistas y los pasajeros.

Abstract:The carrier must make the trip with the diligence necessary to transport the passengers unharmed, thus assuming an obligation of security that can be qualified as a result, inherent in the transport and whose failure must be responded. Regulation (EC) 392/2009 of 23 April, represents a significant step towards a uniform system of liability of the carrier for damage to passengers of different states, since it embodies as a novelty in the near future the application to all Member States of the Athens Convention renovated under the London Protocol 2002 and whose discipline is not only applicable to international transport but also to domestic transport services. This paper analyzes the safety requirement of shipping and the current regime of responsibility for maritime passenger transport derived from the breach at home and abroad and the progressive objectification which is suffering, as the Community Regulation (EC) 392/2009 represents a significant change to establish a hybrid system of liability based on fault and liability based on risk which highlights the need to rebalance the various interests those of carriers and those of passengers.
