Resumen

Esta contestación a la réplica de Ruiz Manero aborda exclusivamente las objeciones
dirigidas a la teoría del Derecho de Kelsen. Las aportaciones de Kelsen a diversas disciplinas
no fueron tocadas por el autor alicantino. Por ello, se intenta refutar la tesis de que la Teoría pura
del Derecho intenta «justificar» hobbesianamente al Derecho positivo. Se presentan argumentos
en contra de la objeción, cuyo origen está en el ensayo de Hart donde relata su visita a Kelsen,
de que la Teoría pura es incapaz conceptualmente de diferenciar entre una multa y un impuesto.
Asimismo, se mantiene la tesis de que el orden jurídico, como orden coactivo, se dirige fundamentalmente
a los órganos del Estado facultados para imponer las sanciones establecidas por el
Derecho y sólo de modo derivado a los particulares. Se intenta presentar la problemática que la
tesis de la «cláusula alternativa tácita» intenta resolver y se demuestra que deriva de la identificación
entre los conceptos de «existencia», «validez» y «regularidad» y finalmente se cuestiona
la viabilidad de una ciencia del Derecho positiva unitaria entre teoría dogmática, razón práctica y sociología.


Abstract:This response to the reply of Ruiz Manero makes reference only to objections formulated
to the theory of Law of Hans Kelsen. Kelsen’s contributions to various disciplines were not approached
by the Alicante author. Therefore, attempts are done to refute the thesis that the Pure
Theory of Law attempts to «justify» a hobbesian conception of positive law. Arguments are presented
against the objection, that the Pure Theory is unable to conceptually distinguish between
a fine and a tax, whose origin is in Hart’s essay in which he describes his visit to Kelsen. It also
maintains the view that the legal system, as a coercive order, is mainly directed to the organs of
State empowered to impose the sanctions provided by the law and only in a derivative way to
particulars. It attempts to present the problems that the theory of «tacit alternative clause» tries
to solve and it is demonstrated that derives from the identification of the concepts of «existence», «validity», and «regularity» and finally questions the viability of a science of positive law that unifies the dogmatic theory, practical or ethical reason and sociology.
